Terms of Service

In consideration of being allowed to participate in any way with Pro-Day Baseball, the undersigned/registrant (parent/legal guardian):

1) Pro-Day Baseball and/or any of its affiliates are not responsible for any injury or loss of property suffered by any individual while playing, practicing, or engaging in any activity whatsoever hosted by Pro-Day Baseball. This includes Negligence on the part of Pro-Day Baseball, its agents, employees, sponsors, volunteers, owners, lessors, lessees and all others that are involved with a hosted activity.

2) In consideration of my being allowed to participate in Pro-Day Baseball activities and related events, I hereby release and covenant not to sue Pro-Day Baseball, its affiliates, employees, owners, and/or agents for any and all present and future claims resulting from negligence on the part of Pro-Day Baseball or others listed for property damage, personal injury, or wrongful death, arising as a result of my engaging or participating in Pro-Day Baseball hosted even or activity, wherever, whenever or however same may occur. I hereby voluntarily waive any and all claims that maybe made by me, my family, estate. heirs or assigns resulting from such negligence, both present and future. In addition to traditional physical injuries that may be related to participation in a Pro-Day Baseball event or activity, this release and waiver of rights shall also apply to communicable diseases and/or conditions, including but no limited to influenza, COVID-19, HIV/AIDS, meningitis, pink eye, hepatitis, and the like.

3) Pro-Day Baseball may use film, voice or photographic records of Pro-Day Baseball Tournament Participation in the activities for its promotional and/or commercial purposes. This includes (but is not limited to) social, media, and other means of marketing via photography, video, live stream, etc

4) I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Missouri and agree that in any portion is held invalid, the remainder of the waiver will continue in full force and effect. I further agree that the venue for any legal proceedings shall be in the State of Missouri.

5) Proday Baseball LLC Refund Policy

Proday Baseball LLC is committed to providing high-quality services and ensuring customer satisfaction. However, due to the nature of certain products and services offered, all sales are final unless otherwise stated in this policy. Refunds will only be considered under exceptional circumstances and at the sole discretion of Proday Baseball LLC.

Tournament Withdrawals:

• Teams withdrawing from a tournament up to 60 days prior to the scheduled start date of the event will be eligible for a full refund, less a $300 withdrawal fee.
• Teams withdrawing within 60 days of the tournament start date will forfeit all tournament fees.

Rainout Policy:

• If the tournament is rained out and no games are played, a full refund will be issued, minus $100 of the tournament fees.
• If one game is played, a 50% refund of the tournament fees will be issued.
• If two or more games are played, no refund will be issued.

All refunds, including those related to withdrawals and rainouts, will take approximately 8 to 10 weeks to process.

Proday Baseball LLC reserves the right to modify or update this refund policy at any time, and any changes will be communicated to customers accordingly.

6) I hereby certify that I, as parent/legal guardian of a Pro-Day Baseball participant, have indeed read this agreement and I agree, for myself, my heirs, assigns, and next of kin, to release and hold harmless and waive subrogation to Pro-Day Baseball from any and all liabilities incident to my minor child’s involvement or participation in Pro-Day Baseball hosted events and activities as provided above, even if arising from negligence, to the fullest extent permitted by law. I hereby assume all risks involved in my minor child’s participation as outlined herein and above.
